Student Enrollment Agreement    

Thank you for choosing Gracie Jiu-Jitsu Council Bluffs! We pride ourselves in providing the safest and most structured learning opportunity in all of Brazilian Jiu-Jitsu, and we are very excited to have you join the family. Please review and acknowledge the following so we can get you started on the Gracie Jiu-Jitsu journey. 

I, THE STUDENT OR THE PARENT ON BEHALF OF THE STUDENT, UNDERSTAND that under the terms of this agreement, the school obligates itself to furnish me/my child with competent instruction and suitable facilities for teaching lessons. All class lessons are supervised by qualified personnel trained in the procedures and traditions of Gracie University. I agree that I/my child is physically fit to receive and participate in the prescribed course of instruction. I agree to faithfully comply with all the rules and regulations of Gracie Jiu-Jitsu Council Bluffs.

MONTHLY PAYMENTS: I understand that if I am enrolling in a paid membership, my/my child’s tuition payments will be made in monthly installments. Any modifications, changes, amendments, or cancellations of this Agreement must be made in writing.

ONLINE CONTENT ACCESS : I understand that upon enrolling in a recurring membership at Gracie Jiu-Jitsu Council Bluffs I will have access to the online content based on my/my child's current enrollment or rank. Access to the online curriculum is a benefit of membership and will be provided for the duration of the membership period. The level of access corresponds to the current enrollment or rank of the participant, and includes instructional videos, training tips, and other digital resources designed to complement the in-person training experience. Access to online content will continue as long as the membership is active and in good standing. In the event of a cancellation, access to online content will be adjusted or revoked in accordance with the membership status.

TWO-PAYMENT CANCELLATION POLICY: I understand that I may cancel my membership at any time by submitting a completed Notice of Membership Cancellation Form provided by Gracie Jiu-Jitsu Council Bluffs. If a cancellation request is submitted through another written method, including email, Gracie Jiu-Jitsu Council Bluffs may require completion of the official cancellation form before processing the cancellation. Upon submitting proper notice, I agree to make two additional monthly tuition payments following the date of submission. My membership will remain active and I may continue to train during this period.

NO ROLLOVER CLASSES: I understand that the budgeted tuition payment plan is not affected by my/my child's training schedule and/or attendance. I am aware that any unused classes within my/my child's current billing cycle will not roll over to the next cycle, nor will I be entitled to a credit for these unused classes. Gracie Jiu-Jitsu Council Bluffs will automatically charge my billing method the discounted rate of $20 (compared to $40 regular drop-in fee) for each class over my monthly limit. 

INJURY POLICIES: I understand that if I/my child becomes injured or disabled for at least three (3) months during the membership period and the injury is confirmed in writing by a physician, I have the right to a freeze the account at no cost or cancel the agreement altogether with a 30-day written notice. 

RESPECT & SAFETY: I understand that belt promotions or other indication of rank is a privilege and not a right. My/my child's acceptance of instruction from this {gym_name} constitutes acknowledgment that I shall treat the students and the facilities with the utmost respect. If at any point, my/my child's behavior is deemed to be unsafe or disrespectful, this training center reserves the right to cancel this agreement and terminate the membership. I shall be entitled to a refund of all unearned amounts due upon cancellation by Gracie Jiu-Jitsu Council Bluffs. 

TRAINING FREEZE: I understand that there is a maximum pause (“freeze”) in monthly payments of two (2) months per twelve-month period, unless otherwise approved in writing by management. If I wish to freeze my membership, a fee of $25 will automatically apply for each month the account is frozen. I understand that I will retain access to the online Gracie University video curriculum during the freeze period. If I choose to attend any in-person classes, open mats, or other training sessions at Gracie Jiu-Jitsu Council Bluffs during the freeze period, I acknowledge that Gracie Jiu-Jitsu Council Bluffs reserves the right to immediately unfreeze my account and resume regular billing for my membership. Any remaining time within the current month’s freeze will be forfeited.

SCHOOL CLOSURES: Gracie Jiu-Jitsu Council Bluffs administrators may make any modifications to the class schedule as deemed necessary. Such modification does not relieve me of my payment obligations under any circumstances. School administrators also reserve the right to close the school on national holidays, for special events, and for a cumulative period of four weeks per calendar year for necessary maintenance and other purposes without affecting scheduled tuition payments. If the school is closed for more than four consecutive weeks and no reasonable alternative training option is provided, you are entitled to cancel this Agreement.

AUTOMATIC PAYMENTS: I authorize Gracie Jiu-Jitsu Council Bluffs to automatically charge the payment method provided for all recurring membership fees, additional class fees, late fees, and other amounts authorized under this Agreement until the membership is properly canceled in accordance with its terms.

LATE CHARGE: I understand that a fee of twenty dollars ($20.00) will be assessed for any payments ten (10) days past due. 

DEFAULT PAYMENTS: I assume all responsibility for all costs related to account collections, including but not limited to reasonable collection agency fees, court costs, reasonable attorney's fees, administrative fees and applicable late charges that may be incurred for default payments.

CHARGEBACKS: I agree not to initiate a chargeback, payment dispute, or reversal for any properly authorized charge. In the event a chargeback or payment dispute is initiated, I remain responsible for all amounts owed under this Agreement, together with any fees, costs, or expenses incurred by Gracie Jiu-Jitsu Council Bluffs in responding to or contesting the dispute.

FAMILY MEMBERSHIP DISCOUNTS: Gracie Jiu-Jitsu Council Bluffs offers a family membership discount program for members who reside at the same billing address and share one billing account. Under this program, the main membership is priced at full price, while the second membership receives a 25% monthly discount and any additional membership receives a 50% monthly discount. The highest-price membership is considered the main membership and the lower-priced memberships receive subsequent discounts in decremental order of price. If any membership within the family changes, such as upgrading, downgrading, or canceling, or a new family member is added, the family membership pricing will be recalculated. Please note that changes to the family membership pricing structure will be communicated to the main account holder via email. It is important to understand that any such changes will not result in the voiding or termination of the membership agreement. {gym_name} reserves the right to modify or discontinue family discount programs prospectively upon reasonable notice. Such changes shall not affect amounts previously paid but may affect future billing cycles.

BY ENTERING INTO THE AGREEMENT I grant the school permission to use photographs, videotapes, artwork or other likenesses of me/my child (the student) for marketing, trade, publishing, or any other lawful purpose, without compensation.

GOVERNING LAW: This Agreement shall be governed by and construed in accordance with the laws of the State of Iowa.

SEVERABILITY: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect

MEMBERSHIP IS non-transferable except as stated herein.

I AUTHORIZE the use of a disclosed e-mail address for billing purposes and acknowledge that e-mail correspondence may include financial information pertaining to the membership.
